In the United States, an SR-22 (sometimes referred to as a certificate of insurance or a financial responsibility filing) is a vehicle liability insurance document required by most state Department of Motor Vehicles (DMV) offices for "high-risk" insurance policies.

A DMV may require an SR-22 from a driver to reinstate his or her driving privileges following an uninsured car accident or conviction of another traffic-related offense, such as a DUI. An SR-22 may be required for three years for conviction of driving without insurance or driving with a suspended license and up to five years for a DUI. If an SR-22 should expire or be canceled, the insurance company is required to issue an SR-26 form, which certifies the cancellation of the policy.

Some states accept an SR-22 as an alternative to a deposit in cash or security as proof of financial responsibility. In Arizona, for instance, a driver seeking reinstatement under some circumstances may submit a SR-22 in lieu of depositing $40,000 in cash or certificates of deposit.

Types of SR-22 forms

There are 3 different types of SR-22 forms:

  • Operator or Non-Owner: An operator/non-owner's form is for drivers who borrow or rent a car but do not own their own car. This form protects the policyholder, not a specific vehicle. It's required in many states, including Arizona and Indiana.
  • Owner: An owner's form is for drivers who own and drive their own car exclusively.
  • Operator/Owner: An operator/owner form is a combination form for drivers who own their own car, but also borrow or rent occasionally.

SR-22 insurance by State

Not every state in the U.S. requires their drivers to file SR-22 forms. But some states usually have their own proof of insurance forms such as a FR-44 or FR-19.

States that do not require any kind of proof of insurance form include Kentucky, Minnesota, New Mexico, New York, North Carolina, Oklahoma, and Pennsylvania.

Filing for an SR-22

Drivers will be told if they need to file for a SR-22 by a court order or a notice from their DMV.

SR-22's cannot be filed by the driver, but need to be filed by their current auto insurance company to ensure authenticity to the DMV. Not all auto insurance companies provide SR22's.

The Cost of an SR-22

The price of filing an SR22 varies by state because they are handled by the state DMV. On average, the filing surcharge is $25 and is a one-time charge.

Insurance rates will increase significantly for drivers that have filed an SR-22 they are considered high risk drivers.
